Joseph Kamotho’s son charged with forgery amid succession row

The son of the late Kanu-era Cabinet minister Joseph Kamotho has been charged with forgery in an alleged attempt to disinherit his siblings of their father’s multi-billion estate.

Charles Githi Kamotho appeared before Milimani Chief Magistrate Wendy Kagendo on Wednesday, December 7, where he denied criminal charges levelled against him by the Office of Director of Public Prosecutions.

He denied forging a doctor’s report filed in court indicating that his sister Marianne Nyokabi Kamotho was of unsound mind, hence unfit to be administrator of their late father’s estate.

“On October 12, 2015, at unknown place within the Republic of Kenya with intent to defraud forged a medical report for Marianne Nyokabi Kamotho purporting it to be a genuine medical report made and signed by Dr. Mucheru Wangombe,” the charge sheet read in part.

In the second count, Kamotho is charged with presenting the forged medical report to the Deputy Registrar of Milimani High Court in a succession matter number 108 of 2017.

The arraignment and prosecution of Githi comes after the Directorate of Criminal Investigations’ forensic unit established that the letter by the doctor was forged.

The accused answered the charges after the court dismissed his plea to differ the plea taking to enable him to resolve the matter out of court.

Githi applied for reasonable cash bail saying the matter is of civil nature and no cash or property was lost.

The magistrate granted him cash bail of Ksh 150,000 or Ksh300,000 surety.
